Gamal and Alaa Mubarak are to be released from prison after a court on Monday ruled that they had completed their three-year sentences on charges of embezzlement in a case known as the "presidential palaces case.”

This comes after both brothers filed a legal challenge against their continuing detention.

Their lawyer, Farid El-Deeb, told the court on Monday that both defendants had served 43 months in prison, therefore exceeding the three-year sentences that were handed out by the court in May.

The Cairo Criminal Court ruled that the legal challenge presented by Hosni Mubarak’s sons fulfilled the requisite legal conditions to prove that the men had served their sentences.

Hosni Mubarak and his two sons were originally convicted in May of embezzling LE125 million ($17.9 million) allocated for developing communications centres for the presidency, in order to develop their own private buildings.

Ousted president Hosni Mubarak was also convicted in the case, but was released from prison after serving his sentence.

Both brothers still face charges of corrupt stock exchange dealings in a separate case that was postponed to 17 October.
