UNGA to discuss the advisory opinion of ICJ on occupied Palestine 17 September

The President of the United Nations General Assembly (UNGA), Philemon Yang, invited the UN member states to attend the 53rd plenary session and deliver their statements next Tuesday (17 September).

This session is to consider an urgent follow-up on the advisory opinion issued on 19 July by the International Court of Justice on "the legal consequences arising from Israel’s policies and practices in the Occupied Palestinian Territory, including East Jerusalem, and the illegality of Israel’s continued presence in the Occupied Palestinian Territory."

On 31 December 2022, the United Nations General Assembly adopted a resolution requesting the International Court of Justice to issue an "advisory opinion" on "the legal consequences arising from Israel's policies and practices in the Occupied Palestinian Territories, including East Jerusalem."

The United Nations referred the advisory opinion immediately after its issuance to the General Assembly for discussion, "based on the permanent responsibility of the United Nations concerning the question of Palestine until it is resolved in all its aspects according to international law and relevant United Nations resolutions."

The court, the highest in the United Nations system, concluded that "Israel's continued presence in the Occupied Palestinian Territory is unlawful [and that] Israel is under an obligation to bring to an end its unlawful presence... as rapidly as possible."

The court went on to say that "Israel is obliged to make reparation for the damage caused to all the natural or legal persons concerned in the Occupied Palestinian Territory."

The ICJ advisory opinion obliged all states of the world "not to recognize as legal the situation arising from the unlawful presence of Israel in the Occupied Palestinian Territory and not to render aid or assistance in maintaining the situation created by the continued presence of Israel."
